1. Object

These general conditions of sale apply automatically to any sale made by the company Art4You SAS, in particular via its website www.art4you.gallery.

These general conditions of sale prevail over any other agreements, pre-agreements, written or oral exchanges that the parties may have concluded or had. Exceptions can only be made by the information given on the front of the invoice issued by Art4You SAS.

2. Condition of property

The goods are sold in the condition in which they are at the time of sale, with any imperfections and defects. In this regard, the buyer is responsible for examining each item before the sale in the descriptive photos of the work presented on the online sales site.

3. Use of the Website

To be able to use the website or become a member, you accept all of its general conditions as well as the confidentiality policy. Art4you reserves the right to modify or discontinue, temporarily or permanently, the Website (or any part thereof) with or without notice. Art4you disclaims all liability to you or any third party for any modification, suspension or abandonment of the site.

To register on the Website, you represent that you are not prohibited by any law and that you are of legal age. You agree to provide truthful information about your identity when registering. You exclude the collection of personal information for commercial and canvassing purposes.

3.1 commands

The goods are offered for sale through the website subject to acceptance of the order by Art4you Gallery and the artist. Art4you and the seller reserve the right to reject any order without having to give the reason. No order will be considered accepted without order confirmation by the seller.

Art4you undertakes to present the works as faithfully as possible on its website, but cannot guarantee that the colors thereof correspond exactly to those displayed on the buyer's image reception device.

3.2 Deliveries

The place of delivery of the goods will be that indicated on the order form. No delivery can be made without the precise information requested for this purpose. Delivery dates are indicative and subject to transport hazards.

Delivery will only take place after payment has been made in the Art4you SAS account.

The costs linked to the possible delivery of the goods (collection, administrative and/or customs procedures, transport, delivery) are covered by Art4You SAS.

The artist and Art4you Gallery shall not be liable for any losses or expenses incurred by the buyer arising from any delay in delivery of the goods, howsoever caused. However, Art4you Gallery will do its best to compensate the buyer to the extent of his responsibility. The goods will be insured during transport up to their values ​​indicated on the site.

The buyer will be required to sign the proof of delivery document or carrier acceptance document.

He will inspect the goods upon receipt and will notify Art4youGallery as quickly as possible in the event of a problem.

In the event of damage noted upon delivery, a description of the damage must be sent to Art4you Gallery the same day. It will be accompanied by one or more photographs.

The buyer has fourteen days following receipt for a legal return. Purchased goods cannot be returned to the seller after 14 days.

If the buyer does not take possession of the goods upon delivery or following the delivery person's stipulations, Art4you is not required to reimburse the purchase price.

When the goods are shipped to a country different from the country of origin of the shipment and, in the event of a refund, it will be partial after deduction of delivery and handling costs.

Art4You Gallery is not responsible for any damage caused to goods after receipt of the order. No returns are possible in this case.

4. Intellectual property rights and copyright

Only physical ownership of the tangible personal property that constitutes the work is transferred. This sale does not in any way imply the transfer of any intellectual property rights or Copyright. Art4you SAS therefore gives no guarantee relating to the intellectual property or copyright rights possibly relating to the property subject to sale.

5. Price

Unless otherwise stated, the price is indicated inclusive of all taxes and does not include packaging and delivery costs.

Payment terms

Payment is made online by the following means:

  • by bank transfer to the contact details indicated on the site,
  • by credit card,
  • By any other means of payment that may be installed on the sales site.

6. reservations of ownership

Pursuant to article 2367 of the Civil Code, Art4YouSAS, or, where applicable, its principal, will remain owner of the goods until full payment by the buyer of the sale price and any additional costs, provided that these These appear on the same invoice as the said price.

As such, if the buyer is subject to receivership or judicial liquidation, the company Art4You SAS reserves the right to claim, as part of the collective procedure, the goods sold and remaining unpaid.

The seller retains ownership of the goods sold until effective payment of the entire price in principal and accessories.

Failure to pay any of the due dates may result in the goods being claimed. The buyer therefore undertakes to insure the goods sold for the benefit of whom they belong against all risks of loss, deterioration and damage that they may run or cause from their receipt.

The retention of title clause suspends the transfer of ownership of the sales contract until full payment of the price or a specific agreement between the parties. Such a suspension does not call into question the firm and final nature of the sale which took place upon agreement of the parties. (Article 1196 al. 1).

7. Export of cultural goods

Export outside of France or import into another country may be subject to obtaining one or more authorization(s) from the administrations.

An exit authorization from the European Union is necessary for the export outside the European Union of cultural goods subject to European Union regulations on the export of cultural heritage (No. CEE 3911/92).

An export certificate for cultural property is necessary to move certain cultural property out of France whose value is greater than or equal to the applicable limit set by the Direction des Musées de France.

Unless they have been obtained by APPLICAT-PRAZAN before the sale or they are not required, Art4you SAS may assist the buyer in obtaining these authorizations, without however being held responsible for any refusal or delay in delivery.

8. Fight against money laundering and terrorist financing

Art4you SAS, as an art dealer, is subject to ordinance number 2016-1635 of December 1, 2016 which transposes the 4th directive relating to the prevention of the use of the financial system for the purposes of money laundering or financing of terrorism.

In this context, Art4you Gallery may be required to ask the buyer for personal information, particularly identification information, in order to comply with its obligations in this area.

10. Amicable settlement of disputes

These general conditions of sale are governed by French law. Any dispute resulting from the formation, interpretation or execution of these general conditions of sale, the sale and any additional service rendered as part of the sale will be under the exclusive jurisdiction of the courts within the jurisdiction of the Court. of appeal from Paris, notwithstanding the plurality of defendants or warranty appeal.
